DMCA Policy

Kawapod respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Kawapod website (the “Site”) that are reported to our Designated Copyright Agent.

If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Site by completing the following Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

1. NOTICE OF ALLEGED INFRINGEMENT (“NOTICE”)

To be effective, the Notice must be in writing and include the following:

  1. Identification of the copyrighted work that you claim has been infringed.

  2. Identification of the material that you claim is infringing (including the URL or a specific description of where the material is located on the Site).

  3. Your contact information, including your full name, mailing address, telephone number, and email address.

  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. COUNTER-NOTIFICATION PROCESS

If you receive a notification that your content has been removed due to a copyright complaint, and you believe the material was removed by mistake or misidentification, you may submit a Counter-Notification.

To be effective, a Counter-Notification must be a written communication that includes:

  • Your physical or electronic signature.

  • Identification of the material that has been removed and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Oregon, if your address is outside of the United States).

4. REPEAT INFRINGER POLICY

Kawapod reserves the right, in its sole discretion, to terminate the accounts of users or remove listings from sellers who are deemed to be repeat infringers under this DMCA Policy.

5. MODIFICATIONS

Kawapod reserves the right to modify the contents of this page and its policy for handling DMCA claims at any time for any reason. You are encouraged to check back and review this policy frequently for any changes.
